("Visitor") desires, at his/her own risk and expense, to enter onto the site(s) listed below (choose all that apply) (the "Premises"), exclusively for recreational or educational purposes. Cox Creek property of the Maryland Port Administration ("MPA"), including the Swan Creek Watershed and/or the Cox Creek Dredged Material Containment Facility (DMCF), 1000 Kembo Road, Curtis Bay, MD 21226 Hart-Miller Island property of the MPA, 2024A Riverview Road, Essex, MD 21221 Hawkins Point property of the MPA, 2401 Hawkins Point Road, Curtis Bay, MD 21226 Masonville Cove property of the MPA, including the Masonville Cove Environmental Education Center and adjacent campus, 1000 Frankfurst Avenue, Curtis Bay, MD 21226; and/or the Masonville Dredged Material Containment Facility, 3030 Childs Street, Curtis Bay, MD 21226 __ Poplar Island property of the MPA, 21548 Chicken Point Road, Tilghman, MD 21671
NOW, THEREFORE, in consideration of being allowed to enter MPA property at the location and for the purpose described above, the receipt and adequacy of which is hereby acknowledged, the undersigned Visitor does hereby remise, release and forever discharge the MPA, the Maryland Transportation Authority (MTA), the Maryland Department of Transportation (MDOT), the Maryland Environmental Service (MES), and all of the officers, agents, and employees, their successors and assigns, and also any and all other persons, associations, corporations and entities, whether herein referred to or not, and who together with the MPA, may jointly or severally be liable to the Visitor, of and from any and all manner of actions and causes of action, rights, suits, covenants, contracts, agreements, judgments, claims and demands whatsoever in law or equity, including, but not limited to, claims arising from and by reason of and bodily and personal injuries or death, damage to property, and the consequence thereof, arising out of or related in any way to Visitor's presence on the entire MPA property/properties, including, but not limited to, the Swan Creek Watershed, Cox Creek DMCF, Hart-Miller Island, Hawkins Point, Masonville Cove, Masonville DMCF, and/or Poplar Island.
As provided by Maryland Code, Natural Resources Article, Section 5-1103, the MPA owes no duty of care to keep the premises safe for entry or use by others for any recreational or educational purpose, or to give any warning of a dangerous condition, use, structure, or activity to any person who enters on the land for these purposes.
From time-to-time MES or its partners may photograph or record images or audio of visitors. By visiting the facility, you and the members of your group acknowledge and agree that their image, likeness, or voice may be used by MES or its partners in conjunction with any of their respective programs, without compensation or any further approvals.
